These Terms of Service (“Terms”) govern your access to and use of the websites, client portal, and services provided by The Hosting Hotel Inc. (“The Hosting Hotel”, “we”, “us”, or “our”), including web hosting, domains, email, SSL certificates, and related services (collectively, the “Services”).

1. Acceptance and eligibility

By creating an account, ordering Services, or using the Services, you agree to these Terms.

You confirm that:

  • You have the legal capacity to enter into a binding agreement in your jurisdiction; and
  • If you are ordering Services on behalf of a business or organization, you have authority to bind that entity.

2. Your account and information

You agree to:

  • Provide accurate, current information and keep it up to date;
  • Keep your login credentials confidential; and
  • Be responsible for all activity under your account.

We may communicate with you about your account, billing, security, and service notices using the contact information on file.

3. Service descriptions and changes

We provide service descriptions and pricing on our website and/or within the client portal (“Service Descriptions”). Service Descriptions may change over time.

If we make a material change that affects active paid Services (for example, a significant feature change or a price change at renewal), we will provide notice in advance through the client portal and/or email.

4. Billing, renewals, and taxes

  • Fees are billed in advance for the billing period you select (monthly, annually, etc.), unless otherwise stated.
  • Renewals may occur automatically unless you cancel prior to renewal.
  • Taxes may apply depending on your jurisdiction.

You are responsible for maintaining a valid payment method on file. If payment fails, we may suspend Services until payment is resolved.

5. Cancellations and refunds

You may cancel Services through the client portal unless otherwise stated for a specific Service.

Refund rules (if any) are described in our Cancellation and Refund Policy. If no separate policy is published, Services are generally non-refundable unless otherwise required by law or explicitly stated at checkout.

6. Support and assistance

We provide support as described for your Service.

Included support generally covers:

  • Guidance on using our portal and services;
  • Answering questions and helping troubleshoot common issues.

Not included (may be quoted as paid services):

  • Full website migrations, email migrations, or complex transfers;
  • Custom development, design, configuration work, or ongoing administration beyond quick guidance.

7. Hosting-specific terms

7.1 Your content

You are responsible for the content you upload, host, or transmit (“Your Content”), including ensuring you have the rights and permissions to use it.

7.2 Resource use and stability

Shared hosting is intended for typical website workloads. We may limit, throttle, suspend, or require changes to workloads that materially impact platform stability or other customers (e.g., excessive CPU/memory, abusive scripts, persistent high load).

7.3 Backups

We may provide backups and restore tools as part of some hosting plans. Backups are provided as a convenience and are not guaranteed. We do not guarantee that backups will be available, complete, current, or successfully restorable. You are responsible for maintaining independent backups of important data.

8. Domains

8.1 Domain registration and availability

Domain availability is not guaranteed. Domain registrations are subject to registrar/registry rules and may be declined or reversed by the registry/registrar.

8.2 Your responsibility

You are responsible for:

  • Ensuring domain name and registrant information is accurate;
  • Domain renewal decisions and maintaining control of your domain; and
  • Following applicable registrar/registry policies.

8.3 Transfers

Domain transfers are subject to registry/registrar rules, timing requirements, and verification steps. We may require identity or authorization verification for transfers for security reasons.

9. Email

You are responsible for:

  • Mailbox usage, security, and credentials;
  • Following anti-spam laws and best practices; and
  • Ensuring DNS settings are correct when using external domains.

We do not guarantee deliverability to every recipient (email delivery can be affected by third-party filtering, reputation, configuration, and content).

10. SSL certificates

SSL certificates are issued and governed by the policies of the issuing certificate authority. Approval, issuance time, and validation requirements vary by certificate type (DV/OV/EV). We cannot guarantee issuance if validation requirements are not met.

11. Acceptable use

You agree not to use the Services for illegal, abusive, harmful, or disruptive activities.

This includes, without limitation:

  • Malware, phishing, credential theft, or other malicious activity;
  • Unauthorized access attempts, scanning, or exploitation;
  • Sending unsolicited bulk email (spam) or operating spam-supporting services;
  • Hosting or distributing pornographic or sexually explicit content;
  • Operating gambling or betting services;
  • Infringement of intellectual property rights;
  • Content or activity that materially interferes with our systems or other customers.

We may investigate suspected violations and take action to protect our network and customers.

12. Suspension and termination

12.1 By you

You may cancel Services through the client portal.

12.2 By us

We may suspend or terminate Services if:

  • Payment is overdue;
  • You violate these Terms; or
  • Your use presents a security, legal, or operational risk.

We may suspend first to prevent harm. In some cases (e.g., severe abuse), we may terminate immediately.

12.3 Data deletion after termination

After termination or cancellation, account data and hosted content may be retained for a limited period before being permanently deleted. Data is typically removed within a reasonable timeframe after service termination, unless retention is required for billing, legal, security, or operational purposes. You are responsible for exporting any data you wish to keep before cancellation.

13. Intellectual property

You retain ownership of Your Content. We do not claim ownership of Your Content.

You grant us a limited right to store, process, transmit, and display Your Content as necessary to provide the Services, comply with law, enforce these Terms, and protect our network.

14. Disclaimers

Services are provided on an “as is” and “as available” basis to the extent permitted by law. We do not guarantee uninterrupted or error-free service, or that the Services will meet every requirement in every environment.

15. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages (including loss of profit, revenue, or data) arising from your use of the Services.

Backups (if provided) are not guaranteed, and we are not liable for failures to restore data.

Our total liability for any claim is limited to the amount you paid for the affected Service during the applicable billing period.

Some jurisdictions limit these exclusions. In that case, the limitations apply to the maximum extent permitted by law.

16. Indemnification

You agree to indemnify and hold harmless The Hosting Hotel Inc. and its directors, officers, employees, and contractors from claims, losses, and expenses (including reasonable legal fees) arising from:

  • Your Content;
  • Your use of the Services; or
  • Your breach of these Terms.

17. Notices

We may provide notices through the client portal, email, or by posting on our website. You are responsible for keeping your contact information current.

18. Changes to these Terms

We may update these Terms from time to time. The latest version will be posted on our website. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

19. Governing law

These Terms are governed by the laws of Ontario, Canada and applicable Canadian federal laws, without regard to conflict of laws principles.
